These Terms of Use govern your access to the Mobile Oil Hero website, online booking flow, text communications, and mobile vehicle maintenance services. By using our website, requesting service, or completing a booking, you agree to these Terms.
1. Eligibility
You must be at least 18 years old and legally able to enter a binding agreement. If you book service for a business, fleet, or another vehicle owner, you represent that you have authority to do so.
2. Services
Mobile Oil Hero provides mobile oil changes and related light vehicle maintenance at the customer's location. Service scope depends on the selected package, vehicle requirements, parts availability, technician judgment, and safe working conditions. We may refuse or stop service if a vehicle or location is unsafe, inaccessible, or outside our operating scope.
3. Service Area
We currently serve selected ZIP codes in the Denver metropolitan area, Colorado. Service-area validation occurs during booking. Submission of a booking request does not guarantee service outside the supported area.
4. Booking and Scheduling
Appointments are requested through our website and scheduling tools. A time slot is not final until confirmed by our systems. You must provide accurate vehicle, address, and contact information. We may reschedule or cancel an appointment due to weather, safety concerns, technician availability, access issues, inaccurate information, or other operational constraints.
If you need to change or cancel an appointment, use the tools we provide or contact us as early as possible. Separate cancellation terms, including same-day and no-show charges, may apply under our posted cancellation policy.
5. Payment Terms
Pricing, fees, and any applicable taxes are shown during booking or before service is completed. By placing a booking, you authorize Mobile Oil Hero and its payment processors to charge the card or payment method you provide for authorized amounts, including service charges, applicable fees, taxes, approved add-ons, late cancellation fees, and no-show fees when permitted by these Terms or other posted policies.
Payment may be collected before, at, or after service depending on the product purchased. We may suspend future bookings or deny warranty support on unpaid balances.
6. Subscription Plans
We may offer subscription products, including monthly plans currently priced at $29.99 per month and yearly plans currently priced at $199.00 per year. Pricing for new purchases may change in the future. Subscription billing renews automatically until canceled.
Subscription benefits are limited to the plan selected, the vehicle covered, active billing status, service-area availability, and any usage limits or scheduling rules displayed at purchase. Add-on services, extra materials, or services outside plan scope may be charged separately. Cancellation stops future renewals but does not automatically create refunds for prior charges except where required by law or expressly stated by us.
7. Service Warranties
Unless otherwise stated in writing, we provide a limited workmanship warranty only for the specific service we performed:
- Synthetic oil service: 5,000 miles or 6 months, whichever comes first.
- Conventional oil service: 3,000 miles or 3 months, whichever comes first.
Warranty coverage applies only to the original customer, only to the serviced vehicle, and only to issues directly caused by our parts or workmanship. The warranty does not cover pre-existing conditions, unrelated mechanical failures, normal wear and tear, customer neglect, ignored warning lights, off-road or abusive use, third-party repairs, tampering after service, or losses caused by delayed reporting.
To request warranty support, contact us promptly within the applicable warranty period and provide proof of service. We may inspect the vehicle before approving a claim.
8. SMS and Communications
If you provide a mobile number and consent to receive text messages, you agree to receive service-related SMS messages from Mobile Oil Hero, including scheduling, reminders, updates, support, and follow-up messages. Consent to receive texts is not a condition of purchase. Message frequency varies. Message and data rates may apply.
You may opt out of marketing or nonessential SMS at any time by replying STOP. For help, reply HELP or contact us. You are responsible for providing a valid number and updating it if it changes.
9. User Responsibilities
- Provide accurate booking, vehicle, and payment information.
- Ensure the vehicle is legally parked and reasonably accessible.
- Provide a safe service location with enough space for our technician to work.
- Follow any pre-service instructions we provide.
- Remain available during the appointment if we need approval or vehicle access.
- Review service records and notify us promptly of any concerns.
10. Prohibited Activities
You may not:
- Provide false, fraudulent, or misleading information.
- Interfere with our technicians, systems, or scheduling tools.
- Attempt unauthorized access to our website, accounts, or infrastructure.
- Use our website or services for unlawful, abusive, or harmful conduct.
- Copy, scrape, reproduce, or exploit our content, branding, or materials without permission.
11. Property Damage and Service Liability
We take reasonable care when performing services. If our negligence directly causes physical damage to your vehicle or other property during service, our responsibility is limited to direct, proven damages. We are not responsible for pre-existing damage, hidden defects, manufacturer issues, normal wear, unrelated component failure, or damage caused by unsafe site conditions you failed to disclose.
12. Limitation of Liability
To the maximum extent permitted by law, Mobile Oil Hero is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of use, towing, rental, lost income, or diminished value. Our aggregate liability for any claim arising from a specific service or transaction will not exceed the amount you paid us for that specific service or transaction.
13. Indemnification
You agree to defend, indemnify, and hold harmless Mobile Oil Hero and its owners, employees, contractors, and agents from claims, liabilities, losses, and expenses arising from your misuse of the website or services, your breach of these Terms, or your violation of law or third-party rights.
14. Intellectual Property
The Mobile Oil Hero website, branding, logos, text, graphics, service marks, and related materials are owned by Mobile Oil Hero or its licensors and are protected by applicable intellectual property laws. Except for limited personal use connected to booking service, no rights are granted to you.
15. Dispute Resolution
Before filing a formal claim, you agree to contact us and attempt to resolve the dispute informally. If a dispute cannot be resolved informally, it will be resolved by binding arbitration on an individual basis in Denver, Colorado, except that either party may bring an eligible claim in small claims court.
Arbitration will be administered under applicable American Arbitration Association rules. You and Mobile Oil Hero waive any right to a jury trial and waive any right to participate in a class, collective, or representative action.
16. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.
17. Changes to These Terms
We may update these Terms from time to time. Updated Terms become effective when posted, unless a different effective date is stated. Your continued use of the website or services after updated Terms are posted constitutes acceptance of the revised Terms.
18. Termination
We may suspend or terminate access to our website, accounts, promotions, or services if we believe you violated these Terms, created risk for our team or systems, or engaged in fraud, abuse, or unsafe conduct.
19. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, together with any posted policy expressly incorporated by reference, form the entire agreement between you and Mobile Oil Hero regarding the website and services covered here.
